By using MailSharks you accept these terms. If you do not agree with them, do not use the service.
MailSharks is a tool that sends messages through your own Google account to recipient lists in your own Google Sheets, lets you compose a message in the built-in editor, and reports statistics. It is not an email provider, never sends messages on its own behalf, and supplies no address lists.
The service may be used by a legally capable person aged 16 or over who has a Telegram account and a Google account. Access is tied to your Telegram account; you are responsible for keeping it secure and for everything done from it. Access may not be shared with third parties. The service can be used free of charge; a paid plan lifts the daily limits — see “Plans and payment”.
The service has two plans. The free plan is always available and needs no card; it has daily limits on messages and API calls, and their current values are listed on the pricing page. The paid Pro plan lifts the service's daily limits. Google's own limits remain in place and do not depend on the plan.
Payments are handled by lava.top. Card details are entered on their side and are never passed to the service: the service only sees that a payment happened, its amount and currency, and the last digits of the card. A subscription renews automatically for the same term at the same price until you cancel it. Cancellation is available in the app at any time, stops further charges, and does not cut short the period already paid for.
The price is fixed at the moment of payment and does not change until the paid term ends; price changes are announced in advance. A refund is possible on request to support and is issued by the same payment provider to the same card; after a refund, access to the paid plan ends.
By uploading a recipient list you instruct the service to process those people's personal data solely to send your messages and display statistics. For that data you are the controller and the service is a processor: it uses the addresses for no purposes of its own, never shares them with other users and builds no lists from them. You warrant that you are entitled to pass this data for such processing, and you answer recipient requests yourself. See the privacy policy for details.
Message texts, templates and lists remain yours. The service is granted the right to store and process them only to do what you ask of it: display them, keep them between sessions and deliver them to recipients. Rights to the application itself, its interface and its code belong to the developer.
Sending volume is limited by your Google account quotas, not by the service. Exceeding Google's limits may lead to a temporary sending block imposed by Google, which is outside the service's control. The service may impose technical limits (request rate, message size, number of templates) where needed to keep it working.
The service is provided “as is”, without warranty of uninterrupted operation, message delivery, or data preservation. Maintenance windows and outages at infrastructure providers may occur. Open statistics are approximate: some mail clients block images, so real opens are always undercounted.
The service is not liable for undelivered messages, messages classified as spam, suspension of your Google or Telegram account, lost profits, data loss, or any indirect damages arising from use of the service. Liability is limited to the maximum extent permitted by applicable law and in any case does not exceed the amount you paid for the subscription over the last twelve months.
If a third party or a supervisory authority brings a claim against the service because of your mailing — its content, the absence of a lawful basis, or infringement of recipients' rights — you undertake to resolve that claim yourself and to reimburse the service for the costs it incurs.
Access may be restricted without notice for breach of these terms, including use of the service for spam. You may stop using the service at any time by revoking the application's access in your Google account settings and requesting deletion of your data.
These terms are governed by the law of the developer's country of residence; if you are a consumer, this does not deprive you of the protection of mandatory rules of your own country. The parties will first try to settle disputes by writing to mailsharks.support@gmail.com, with a reply within 30 days.
These terms may be updated; the current version is published at
https://mailsharks.org/terms. Continuing to use the service after a change
means you accept the new version.
