Terms of Service

By using MailSharks you accept these terms. If you do not agree with them, do not use the service.

1. What the service provides

MailSharks is a tool that sends messages through your own Google account to recipient lists in your own Google Sheets, lets you compose a message in the built-in editor, and reports statistics. It is not an email provider, never sends messages on its own behalf, and supplies no address lists.

2. Who may use it

The service may be used by a legally capable person aged 16 or over who has a Telegram account and a Google account. Access is tied to your Telegram account; you are responsible for keeping it secure and for everything done from it. Access may not be shared with third parties. The service is currently free of charge, and this may change with prior notice.

4. Processing of recipient data

By uploading a recipient list you instruct the service to process those people's personal data solely to send your messages and display statistics. For that data you are the controller and the service is a processor: it uses the addresses for no purposes of its own, never shares them with other users and builds no lists from them. You warrant that you are entitled to pass this data for such processing, and you answer recipient requests yourself. See the privacy policy for details.

5. Content you create

Message texts, templates and lists remain yours. The service is granted the right to store and process them only to do what you ask of it: display them, keep them between sessions and deliver them to recipients. Rights to the application itself, its interface and its code belong to the developer.

6. Limits

Sending volume is limited by your Google account quotas, not by the service. Exceeding Google's limits may lead to a temporary sending block imposed by Google, which is outside the service's control. The service may impose technical limits (request rate, message size, number of templates) where needed to keep it working.

7. Availability and disclaimer of warranties

The service is provided “as is”, without warranty of uninterrupted operation, message delivery, or data preservation. Maintenance windows and outages at infrastructure providers may occur. Open statistics are approximate: some mail clients block images, so real opens are always undercounted.

8. Limitation of liability

The service is not liable for undelivered messages, messages classified as spam, suspension of your Google or Telegram account, lost profits, data loss, or any indirect damages arising from use of the service. As the service is provided free of charge, liability is limited to the maximum extent permitted by applicable law.

9. Indemnity

If a third party or a supervisory authority brings a claim against the service because of your mailing — its content, the absence of a lawful basis, or infringement of recipients' rights — you undertake to resolve that claim yourself and to reimburse the service for the costs it incurs.

10. Termination

Access may be restricted without notice for breach of these terms, including use of the service for spam. You may stop using the service at any time by revoking the application's access in your Google account settings and requesting deletion of your data.

11. Governing law and disputes

These terms are governed by the law of the developer's country of residence; if you are a consumer, this does not deprive you of the protection of mandatory rules of your own country. The parties will first try to settle disputes by writing to mailsharks.support@gmail.com, with a reply within 30 days.

12. Changes to these terms

These terms may be updated; the current version is published at https://mailsharks.org/terms. Continuing to use the service after a change means you accept the new version.
